وعن عبادة بن الصامت رضي الله عنه أن رسول الله صلى الله عليه وسلم قال‏:‏ ‏"‏ما على الأرض مسلم يدعو الله تعالى بدعوة إلا آتاه الله إياها، أو صرف عنه من السوء مثلها‏.‏ ما لم يدع بإثم، أو قطيعة رحم‏"‏ فقال رجل من القوم‏:‏ إذًا نكثر قال‏:‏ ‏"‏الله أكثر‏"‏‏.‏ رواه الترمذي وقال حديث حسن صحيح‏.‏
 
Translation:
Hazrat 'Ubadah bin As-Samit Radiallahu Anhu  said:
The Messenger of Allah (ﷺ) said, "Whenever a Muslim supplicates Allah, He accepts his supplication or averts any similar kind of trouble from him until he prays for something sinful or something that may break the ties of kinship." Upon this someone of the Companions said: "Then we shall supplicate plenty." The Messenger of Allah (ﷺ) said, "Allah is more plentiful (in responding)." [ Riyadhus Saaliheen, 1501]

Question Summary:
Will my Duas still be accepted after consuming Haram?

Question Detail:

Assalamualaikum, 
         Muhtaram Hazrat Mullah Sahab,
I know someone who intentionally ate something Haraam and he found out about the Hadees which says that Allah will not accept the Duas of the person who intentionally eat something Haram for 40 days! He is now also going for Umrah and has made sincere Taubah, but he is still worried wheather his Duas are going to be accepted after his Taubah within the 40 days as he is also going for Omrah shortly and plans to make lots of Duas there. Please help him as he is really worried and stressed out.

Answer :

In the Name of Allah, the Most Gracious, the Most Merciful.
As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.
Each and every human being makes mistakes intentionally or unintentionally. In principle, if a person commits a major sin and makes sincere tawbah, Allah Ta’ala will accept his repentance. Allah says in the Holy Quran;
Ayat 1
وَتُوبُوا إِلَى اللَّهِ جَمِيعًا أَيُّهَ الْمُؤْمِنُونَ لَعَلَّكُمْ تُفْلِحُونَ
Translation:
Turn in repentence to Allah altogether, O believers. Perhaps you will be successful.
[ Al Nur, Ayat:31]
 
Ayat 2
يَاأَيُّهَا الَّذِينَ آمَنُوا تُوبُوا إِلَى اللَّهِ تَوْبَةً نَصُوحًا عَسَى رَبُّكُمْ أَنْ يُكَفِّرَ عَنْكُمْ سَيِّئَاتِكُمْ
Translation:
O believers! Turn to Allah in sincere repentance. It may well be that your Rabb will remove from you your sins[ At Tahrim , Ayat 8] 
 
Rasulullah Salallahu Alaihi Wasallam has mentioned in a Hadith that:
 
حَدَّثَنَا إِبْرَاهِيمُ بْنُ يَعْقُوبَ، حَدَّثَنَا عَلِيُّ بْنُ عَيَّاشٍ، حَدَّثَنَا عَبْدُ الرَّحْمَنِ بْنُ ثَابِتِ بْنِ ثَوْبَانَ، عَنْ أَبِيهِ، عَنْ مَكْحُولٍ، عَنْ جُبَيْرِ بْنِ نُفَيْرٍ، عَنِ ابْنِ عُمَرَ، عَنِ النَّبِيِّ صلى الله عليه وسلم قَالَ ‏ "‏ إِنَّ اللَّهَ يَقْبَلُ تَوْبَةَ الْعَبْدِ مَا لَمْ يُغَرْغِرْ ‏"‏ ‏.‏ قَالَ أَبُو عِيسَى هَذَا حَدِيثٌ حَسَنٌ غَرِيبٌ ‏.‏

Translation:
 Hazrat Ibn `Umar Radiallahu Anhu narrated that the Prophet (ﷺ) said:
“Indeed Allah accepts the repentance of a slave as long as (his soul does not reach his throat).” [Tirmidhi 3537]
 
حَدَّثَنَا يَعْقُوبُ بْنُ حُمَيْدِ بْنِ كَاسِبٍ الْمَدَنِيُّ، حَدَّثَنَا أَبُو مُعَاوِيَةَ، حَدَّثَنَا جَعْفَرُ بْنُ بُرْقَانَ، عَنْ يَزِيدَ بْنِ الأَصَمِّ، عَنْ أَبِي هُرَيْرَةَ، عَنِ النَّبِيِّ ـ صلى الله عليه وسلم ـ‏ "‏ لَوْ أَخْطَأْتُمْ حَتَّى تَبْلُغَ خَطَايَاكُمُ السَّمَاءَ ثُمَّ تُبْتُمْ لَتَابَ عَلَيْكُمْ ‏"‏ ‏.‏ قَالَ ‏:‏
 
Translation:
It was narrated from Abu Hurairah that the Prophet (ﷺ) said:
“If you were to commit sin until your sins reach the heaven, then you were to repent, your repentance would be accepted.” [ Ibn Majah, 4389]
 
However from the above mentioned ayaats and ahadeeth we understand if one makes sincere tawba after commiting a sin, Allah will accept his repentence. Hence, the procedures of sincere tawba are as follows:1
 
1)    One must refrain from committing the sin.
2)    One must express remorse over committing it.
3)    On must make a form resolution never to return to that sin.
 
 
 
Thus, in the enquired situation if the person made tawba with the procedures in reference, his tawba will be accepted. After sincere tawba, his duas will be accepted. 2
