What is the ruling in the mathaahib of not cutting the hair or clipping the nails for the non haji during the first ten days of zul hijjah?

Answer :

In the Name of Allah, the Most Gracious, the Most Merciful.
As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.
 
Rasulullah salallahu alayhi wasallam said:
 
“When the ten days (of Dhul Hijjah) begin and a person has an animal for sacrifice which he intends to slaughter, then let him not cut his hair or trim his nails.” (Muslim hadith no.1977)[1]
 
According to the Hanafī school, Ibn Abīdīn rahimahullah mentions in his commentary on the famous al-dur al-mukhtār that it is mustahab (preferable) not to cut the hair or clip the nails for one who intends to sacrifice an animal for the sacrificial slaughter.[2] 
 
῾Allāmah Khalīl ibn Ishāq al-Malikī rahimahullah of the Malikī school of jurisprudence that it is mustahab (preferable) not to cut the hair or clip the nails for one who intends to sacrifice an animal for the sacrificial slaughter.[3] 
 
The renown Shāfi῾ī scholar Imam Nawawi rahimahullah mentions that it sunnah for one who will be performing the sacrifice not to cut the hair or clip the nails.[4]  
 
The famous Hanbali jurist Ibn Qudāma rahimahullah states that is wājib not to cut the hair or clip the nails for one who intends to sacrifice an animal for the sacrificial slaughter.[5]

 عَنْ أُمِّ سَلَمَةَ، تَرْفَعُهُ، قَالَ: «إِذَا دَخَلَ الْعَشْرُ وَعِنْدَهُ أُضْحِيَّةٌ يُرِيدُ أَنْ يُضَحِّيَ، فَلَا يَأْخُذَنَّ شَعْرًا، وَلَا يَقْلِمَنَّ ظُفُرًا» (رقم الحديث 1977)

[خَاتِمَةٌ] قَالَ فِي شَرْحِ الْمُنْيَةِ: وَفِي الْمُضْمَرَاتِ عَنْ ابْنِ الْمُبَارَكِ فِي تَقْلِيمِ الْأَظْفَارِ وَحَلْقِ الرَّأْسِ فِي الْعَشْرِ أَيْ عَشْرِ ذِي الْحِجَّةِ قَالَ لَا تُؤَخَّرُ السُّنَّةُ وَقَدْ وَرَدَ ذَلِكَ وَلَا يَجِبُ التَّأْخِيرُ اهـ وَمِمَّا وَرَدَ فِي صَحِيحِ مُسْلِمٍ قَالَ رَسُولُ اللَّهِ - صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ - «إذَا دَخَلَ الْعَشْرُ وَأَرَادَ بَعْضُكُمْ أَنْ يُضَحِّيَ فَلَا يَأْخُذَنَّ شَعْرًا وَلَا يُقَلِّمَنَّ ظُفُرًا» فَهَذَا مَحْمُولٌ عَلَى النَّدْبِ دُونَ الْوُجُوبِ بِالْإِجْمَاعِ (ج 2 ص 181 أيج ايم سعيد)

وَيُسَنُّ لِمُرِيدِهَا أَنْ لَا يُزِيلَ شَعْرَهُ وَلَا ظُفْرَهُ فِي عَشْرِ ذِي الْحِجَّةِ حَتَّى يُضَحِّيَ.(ج 6 ص 135 دار الحديث)

 

[5]  وفي المغني لابن قدامة

(وَمَنْ أَرَادَ أَنْ يُضَحِّيَ، فَدَخَلَ الْعَشْرُ، فَلَا يَأْخُذْ مِنْ شَعْرِهِ وَلَا بَشَرَتِهِ شَيْئًا) إذَا ثَبَتَ هَذَا، فَإِنَّهُ يَتْرُكُ قَطْعَ الشَّعْرِ وَتَقْلِيمَ الْأَظْفَارِ، فَإِنْ فَعَلَ اسْتَغْفَرَ اللَّهَ تَعَالَى. وَلَا فِدْيَةَ فِيهِ إجْمَاعًا، سَوَاءٌ فَعَلَهُ عَمْدًا أَوْ نِسْيَانًا.(ج 13 ص 124-123 دار الحديث)
