Question Summary: Ruling of Tahajjud Salaah with Jamaat Question Detail:
1.What is the ruling of performing Tahajjud Namaz in Jamat (famously called Shabeena / Qiyaamul Layl) which is carried out especially during the last ten days of Ramzan? 2. If there are both views what are the proofs of both sides from Quran and Hadith and views of Ulama? 3. Is there any difference in the number of people attending or it being advertised?
Answer :
‘Shabeena’ is an optional (Nafl) salaah. According to Imam Abu Hanifah رحمه الله optional salaah with congregation is permissible if there are three or less followers behind the Imam. It is makrooh (disliked) to perform Nafl salaah with congregation of four or more people behind the Imam. [1], [2] Nafl salaah with congregation being makrooh is also the opinion of Imam Malik .رحمه الله Performing any other Nafl salaah besides taraweeh and witr with congregation is not preferred in the Shafie school of thought. According to Imam Ahmad bin Hambal رحمه الله , it is permissible to perform Nafl salaah with congregation.[3] A muqallid (follower of an Imam of a school of thought) is bound to adhere to his mazhab and tolerate the practice of other mazhabs. . [3] قَال الْحَنَفِيَّةُ : تُكْرَهُ الْجَمَاعَةُ فِي صَلاَةِ النَّوَافِل .
وَقَال الْمَالِكِيَّةُ كَذَلِكَ : تُكْرَهُ الْجَمَاعَةُ فِي النَّوَافِل ، لأَِنَّ شَأْنَ النَّفْل الاِنْفِرَادُ بِهِ ، كَمَا تُكْرَهُ صَلاَةُ النَّفْل فِي جَمْعٍ قَلِيلٍ بِمَكَانٍ مُشْتَهِرٍ بَيْنَ النَّاسِ ، وَإِنْ لَمْ تَكُنِ الْجَمَاعَةُ كَثِيرَةً وَالْمَكَانُ مُشْتَهِرًا فَلاَ تُكْرَهُ .
وَقَال الشَّافِعِيَّةُ : تُسْتَحَبُّ الْجَمَاعَةُ فِي التَّرَاوِيحِ وَالْوِتْرِ فِي رَمَضَانَ ، وَلاَ يُسْتَحَبُّ فِعْل سَائِرِ الرَّوَاتِبِ جَمَاعَةً .
وَقَال الْحَنَابِلَةُ : يَجُوزُ التَّطَوُّعُ جَمَاعَةً وَمُنْفَرِدًا ؛ لأَِنَّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَعَل الأَْمْرَيْنِ كِلَيْهِمَا [الموسوعة الفقهية الكويتية – ٢٥٢٨٣ ]
