Questions regarding investing, zakah and salah

Question Detail:

 
Question no 1.  10 % of basic salary is deducted from salary and 10 % is contributed from my employer. Now the total money is invested somewhere and I don’t know where they invest that and neither I can trace that.
 
So my question is that is that Profit allowed or not. And if it’s not allowed in case could I take that at the end of my service and give that ( Profit ) as a charity.
 
Question 2 . can we eat at onion at night time. After  ISHA prayers if we take the dinner. Or even if we paste before going  to masjid.
 
Question 3 . standing WAZU Is allowed or not.  Ablution in toilet is allowed or not or can we recite DUHA after wazu there.
 
Question 4 .  My wife father works in bank, at the time of my marriage this thing didn’t came in to my mind  that either her father earning will be HALAL or HARAM.  So now after almost 2 years and having one daughter this thing bother me to  much that weather her father earning is HALAL or HARAM, as she visit her parents home frequently and stay there for 1 week.
So please suggest me what should I do, either ask her not visit there or visit there don’t eat anything or don’t use her parents money. Please advise.
 
 
Question No 5
 
I have tried my level best out but I can’t wake up for morning prayers. Even if I sleep at 8 pm even then I can’t wake up at 5am. But still whatever time I wake up the first thing I do when I wake is to offer morning namaz if that time is not MAKROOH. Please if you can suggest something that I can recite so that I can wake in the morning.

I pay 10 % as charity of whatever I earn  and after that on my savings ZAKAT has to be paid or not?
 
 

Answer :

In the Name of Allah, the Most Gracious, the Most Merciful.
As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.
1. It is possible to trace the investment of the funds by contacting the HR department or the organization overseeing the management of your funds. You should make due diligence in finding out the full details. Without this vital information, the Darul Iftaa cannot issue a proper ruling.
 
2. Yes, onions are permissible to eat. However, a person should not enter the masjid without cleaning the teeth with miswak or toothpaste, especially if eaten raw. This prohibition is not limited to onions only but includes any food that has a strong odor like garlic, leeks, etc because it will be a cause of inconvenience to the angels and the Muslims. [i]
 
3. Yes, performing wudu while standing is permissible but it is better for a person to make wudu sitting. Yes, you can perform wudu in a bathroom that has a toilet. However, the dua of wudu should be recited in the heart and not verbally. [ii]
 
4. Banks today have many departments and sections. As a result, a bank employee's involvement with interest or assisting in sin is hard to gauge without a detailed job profile. Please forward the relevant details of your father-in-law's exact work so a proper ruling can be issued.
 
5. In your heart, determine an amount of money you will give in sadaqah if you fail to wake up for Fajr on any given day. This amount should not be so much that you have trouble giving it, nor so little that you consider it trivial. Insha-Allah, this will help you in getting up for Fajr.
 
6. You have to give Zakat regardless of the non-obligatory charity you give out from your earnings/savings as long as you are Sahib nisab (a person upon whom Zakat is fardh).

Clarification
The Darul Iftaa has received queries regarding Mufti Ebrahim Desai Saheb’s teaching and affiliation with Madrassah In’aamiyya, Camperdown. The confusion is probably due to the previous Fatawaa and Google searches of Mufti Ebrahim Desai Saheb issued under the name of Darul Iftaa, Madrassah In’aamiyyah, Camperdown.

Mufti Ebrahim Desai Saheb has resigned from Madrassah In’aamiyya two years ago and has no affiliation with Madrassah In’aamiyya, Camperdown.


Mufti Saheb has established the Darul Iftaa in Durban that facilitates for post-Ulama courses and training Mufti’s. He teaches Hadeeth at Darul Uloom Nu’maniyyah.

قوله وأكل نحو ثوم) أي كبصل ونحوه مما له رائحة كريهة للحديث الصحيح في النهي عن قربان آكل الثوم والبصل المسجد. قال الإمام العيني) [i]
في شرحه  على صحيح البخاري قلت: علة النهي أذى الملائكة وأذى المسلمين ولا يختص بمسجده - عليه الصلاة والسلام -، بل الكل سواء لرواية مساجدنا بالجمع، خلافا لمن شذ ويلحق بما نص عليه في الحديث كل ما له رائحة كريهة مأكولا أو غيره، وإنما خص الثوم هنا بالذكر وفي غيره أيضا بالبصل والكراث لكثرة أكلهم لها

عبارة الغزنوية ولا يتكلم فيه أي: في الخلاء. وفي الضياء عن بستان أبي الليث: يكره الكلام في الخلاء. وظاهره أنه لا يختص بحال قضاء الحاجة [ii]
 وذكر بعض الشافعية أنه المعتمد عندهم، وزاد في الإمداد ولا يتنحنح أي: إلا بعذر، كما إذا خاف دخول أحد عليه. اهـ. ومثله بالأولى ما لو خشي وقوع محذور بغيره؟ ولو توضأ في الخلاء لعذر هل يأتي بالبسملة ونحوها من أدعيته مراعاة لسنة الوضوء أو يتركها مراعاة للمحل؟ والذي يظهر الثاني لتصريحهم بتقديم النهي على الأمر تأمل.
