Question Detail:

Assalamu alaikum Mufti Sahab, I had an issue regarding an unmarried person giving talaq to his future wife .... The statement goes like this "Talaq talaq talaq i give three consecutive talaq's to my future wife" but this statement has been said without any intention of giving just as a fun among our friends Mufti sahab I've heard that this type of talaq make a person to fall in a kind of loop like, Any time he gets married, but due to this statement of giving talaq my future wife the Nikah becomes invalid so as it proceeds with the further nikah... And the person cannot withstand with a nikah Mufti please clarify this issue Jazakallahu khairan

Answer :

In the Name of Allāh, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

It is irresponsible to make fun by issuing talaq. Talaq is a sensitive issue with major implications. One should exercise precaution when issuing talaq.

If an unmarried person issued divorce to his future wife, that does not constitute talaq as in the case of reference.^[1]

However, if one suspended divorce on marrying a woman, then that constitutes a divorce, for example an unmarried person says, if I marry a woman, she is divorced. In this example, the divorce is suspended on the condition of marrying. That is not so in the enquired situation as the talaq is not suspended on marrying.

لو قال لأجنبية أنت طالق مع نكاحك حيث يأتي فيه التقرير المذكور مع أنه لا يقع إذا تزوجها
