Question Summary:
Is it permissible for me to wear jeans under my abaya (cloak)?

Question Detail:

I have a question regarding women wearing jeans.
Would it be okay for a covering lady to wear jeans under her abaya (cloak) at home with her kamees for the purpose of staying warm? The material is stretchy and it keeps the body warmer than normal cotton salwars.

If this is okay, will it be permissible to wear them and pray without the act of becoming Makrūh? (As the pants are not as loose as salwar, but are not as tight as leggings either).

In the Name of Allah, the Most Gracious, the Most Merciful.

 

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

 

Islam has ordered us that we dress modestly. Allah Ta’alā says:

يَا بَنِي آدَمَ قَدْ أَنْزَلْنَا عَلَيْكُمْ لِبَاسًا يُوَارِي سَوْآتِكُمْ وَرِيشًا وَلِبَاسُ التَّقْوَى ذَلِكَ خَيْرٌ ذَلِكَ مِنْ آيَاتِ اللَّهِ لَعَلَّهُمْ يَذَّكَّرُونَ  [الأعراف: 26]

“O Children of Adam! We have, indeed, bestowed upon you a sense of want for clothing to cover your secret parts and garment of fearing Allah that is the best of human adornment. This is of the manifest signs of One Allah that they may remember His mercy and be thankful.”(7:26)

 

In a Hadith, it has been mentioned:

 

عَنْ أَبِي مَسْعُودٍ، قَالَ النَّبِيُّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ: «إِنَّ مِمَّا أَدْرَكَ النَّاسُ مِنْ كَلاَمِ النُّبُوَّةِ، إِذَا لَمْ تَسْتَحْيِ فَاصْنَعْ مَا شِئْتَ)… صحيح البخاري (4/ 177(

“Amongst the things that people have learnt from the prophetic teachings; when your modesty is lost, you may do whatever you feel like.” (Bukhari 4:177)

 


Modesty in dressing will be if:

1.      The clothing is loose that the shape of the body is not exposed.[1]

2.      The clothing must not resemble the clothing of the opposite gender.[2]
3.      The dressing should resemble the dressing of the Sulahā (pious people). According to many Ulama, wearing the jeans is disliked and it is not from the dressing of the Sulahā.
 
However, in your scenario, it is permissible for you to wear jeans and the Salāh will be valid as long as the Satr is covered.[3]

(قَوْلُهُ وَلَا يَضُرُّ الْتِصَاقُهُ) أَيْ بِالْأَلْيَةِ مَثَلًا، وَقَوْلُهُ وَتَشَكُّلُهُ مِنْ عَطْفِ الْمُسَبَّبِ عَلَى السَّبَبِ. وَعِبَارَةُ شَرْحِ الْمُنْيَةِ: أَمَّا لَوْ كَانَ غَلِيظًا لَا يُرَى مِنْهُ لَوْنُ الْبَشَرَةِ إلَّا أَنَّهُ الْتَصَقَ بِالْعُضْوِ وَتَشَكَّلَ بِشَكْلِهِ فَصَارَ شَكْلُ الْعُضْوِ مَرْئِيًّا فَيَنْبَغِي أَنْ لَا يَمْنَعَ جَوَازَ الصَّلَاةِ لِحُصُولِ السَّتْرِ.
