I am really confused and would like a fatwa on the two questions below. I have looked at other fatwas but not convinced, please can i have a fatwa. I appreciate you are busy. could you please reply ASAP. Question regarding actual divorce statement and metaphors:
1) If a person is suffering from a lot of divorce thoughts, doubts and waswasa, and due to these thoughts the person finds himself repeating just the word 'divorce' and just the word 'divorced' silently without any intention of divorce. Would that count as a divorce? He has no intention of any divorce.
2) if a person WRITES e-mail to a maulana to find out the ruling or just to know the answer and on the e-mail its written that they said or wrote "you are divorced." or a statement,but in reality they didn't say it or write it (on the e-mail the person has written 'dear maulana I have said or written the statement you are divorced'). But wrote this email just to find the ruling. would that count just because they wrote in the email that they said it or wrote it. when in reality it was to find the ruling or answer. What is the state of the nikkah? The person has not said it or written it but just writes this in the email. Or If the person verbally asks a maulana the same scenario as mentioned in question 2 to find the ruling instead of writing in email. What is the state of the nikkah? would that count just because that person asks VERBALLY to find the ruling.
