Question Summary: Is the Nikaah and Umrah of a drunkard valid or not? Question Detail:
I have a question regarding nikaah. I have heard that if a person drinks alchol for forty days his prayers are not accepted. Now that if his nikaah is within those fory days, will that be accepted? And weather doing Umrah within fory days be accepted or not?
Answer :
In the Name of Allah, the Most Gracious, the Most Merciful. As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh. “Whosoever consumes wine, his Salah will not be accepted for 40 days. If he repents, Allah will forgive him….” The Hadith simply means that a person who consumes wine will not receive the reward for his good actions for forty days until he repents. However, if this person sincerely repents for his sin of drinking, he will be forgiven and his reward for good actions will resume. The Hadith specifically mentions Salah since it is the most important aspect of Deen. When a person is in the habit of drinking intoxicants, his mind and soul is not in Salah, thus depriving him of the long lasting spiritual effects of Salah which is interpreted as 40 days. An addict’s heart and soul is always in his addiction. Nevertheless, if a person is intoxicated while performing Salah, his Salah will not be valid. The Nikaah of a drunkard is not valid if he is intoxicated at the time of Nikaah. However, if he is not in the state of intoxication and is conscious of what is happening around him, his Nikaah will be valid. If a person is not intoxicated at the time of performing Umrah, his Umrah will be valid.
