Question Detail:

about 8 months ago i found out my wifer was talking to other females about what was going on in our bedroom. in that moment of anger i told her that if she talks to another person about what happens in out bedroom she must go back to her mums house. i think my intention was divorce. i have now found out that she has continued talking about these issues to other woman for the last 6-8 months.what is the status of my Nikkah? i have never uttered the words talaak to her.

Answer :

In the name of Allah, Most Gracious, Most Merciful
Assalaamu `alaykum waRahmatullahi Wabarakatuh
Firstly, it should be noted that it is not necessary to literally utter the words of divorce in order for the divorce to take place. Talaaq takes place with such words also which metaphorically denotes upon divorce with the intention of divorce.
Secondly, you have stated in your query that you think you intended divorce. The ruling of your marriage will depend on the level of your thought. If you merely have a doubt (and you cannot give preference to whether you really intended divorce or not), then your nikah will still remain intact. On the contrary, if you have a greater thought (dhann ghalib) that you really did intend divorce, then the marriage between you and your wife will be terminated. In order to reconcile with your wife, a new nikah should be made.
