Question Detail:

Salaam Does the following count as not talaq. Husband and wife were arguing. Based on wife’s words, the husband picked up the phone and said “I’ll let my parents know that it’s a divorce” but did not have any intention of giving talaq. The husband didn’t end up contacting anyone on the phone though. It was a threat.

Answer :

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

The statement “I’ll let my parents know that it’s a divorce” constitutes a promise and a threat to divorce. A promise of divorce is not considered a talaaq (divorce) in Shariah. ^[i]

You state the husband did not contact anyone; therefore, the divorce did not take place.

However, the husband should avoid threatening the wife with such statements, as such statements causes pain to the wife and have a potential of divorce.

وبالعربية قوله: أطلق، لا يكون طلاقاً في أنه دائر بين الحال والاستقبال فلم يكن تحقيقاً مع الشك حتى أن موضع علمت استعماله للحال كان تحقيقاً
