Hanafi Husband and Ahle hadeeth wife

Question Detail:

I need to ask you something important and personal
I am Alhamdulillah Hanafi and my wife is Ahle-hadees, sometime it creates differences on different matter for this I have a few question
1)      Ghul we do in hanafi madhab with 3 fraiz but in ahle-hadees you don’t need to gargil or clear nose till soft bone just perform wuzu and clear your body as no body part left dry
2)      Ghusal after menstruation and intercourse are same? They say you don’t need to perform wuzu even after menstruation cycle?
I may have more matter which I will have to discuss in future, first I need to know the above mentioned with the reference if possible, so I can make her understand.
Is there any dua to recite that she accepts correct believe

Answer :

In the Name of Allah, the Most Gracious, the Most Merciful.
As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.
You state your wife is Ahle hadeeth and does not follow a madhab. It is imperative you explain to her the importance in following a specific Madhab, otherwise the individual would only be following his/her desires.
 You may refer your wife to the following books for an in-depth understanding on the issue of Taqleed.

According to the Hanafi madhab, gargling and clearing the nose with water is Fardh in ghusl. According to some madhabs they are Sunnah in ghusl. Even though your wife is not Hanafi, she still should gargle and clear the nose. Moreover, we don’t see why gargling and clearing the nose with water should be a problem, as there is no difficulty and inconvenience in doing so during ghusl.[1]
After menstruation, ghusl is compulsory upon the individual[2]. Allah Ta’ala says in the Quran,
 وَإِنْ كُنْتُمْ جُنُبًا فَاطَّهَّرُوا
And if you are in a state of Janaba(impurity), purify yourself(bathe your whole body)(AlMaaidah ayah 6)
Therefore, there is no difference of opinion amongst the Ulama and Madhabs that Ghusl is compulsory after menstruation.

(وَإِذَا نَسِيَ الْمَضْمَضَةَ، وَالِاسْتِنْشَاقَ فِي الْجَنَابَةِ حَتَّى صَلَّى لَمْ يُجْزِهِ) ، وَهُوَ عِنْدَنَا الْمَضْمَضَةُ، وَالِاسْتِنْشَاقُ فَرْضَانِ فِي الْجَنَابَةِ سُنَّتَانِ فِي الْوُضُوءِ، وَقَالَ الشَّافِعِيُّ - رَضِيَ اللَّهُ تَعَالَى عَنْهُ - سُنَّتَانِ فِيهِمَا، وَقَالَ أَهْلُ الْحَدِيثِ فَرْضَانِ فِيهِمَا، وَمِنْهُمْ مَنْ أَوْجَبَ الِاسْتِنْشَاقَ دُونَ الْمَضْمَضَةِ، وَاسْتَدَلُّوا بِمُوَاظَبَةِ رَسُولِ اللَّهِ - صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ - عَلَيْهَا فِي الْوُضُوءِ

 

بدائع الصنائع في ترتيب الشرائع (1/ 34)

وَلِهَذَا وَجَبَتْ الْمَضْمَضَةُ، وَالِاسْتِنْشَاقُ فِي الْغُسْلِ، لِأَنَّ إيصَالَ الْمَاءِ إلَى دَاخِلِ الْفَمِ، وَالْأَنْفِ مُمْكِنٌ بِلَا حَرَجٍ

 وَقَدْ تَقَدَّمَ مَعْنَى الْمَضْمَضَةِ وَالِاسْتِنْشَاقِ وَأَنَّ الْمُبَالَغَةَ فِيهِمَا سُنَّةٌ فِي الْوُضُوءِ، وَكَذَلِكَ فِي الْغُسْلِ لِقَوْلِهِ - صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ - «بَالِغْ فِي الِاسْتِنْشَاقِ إلَّا أَنْ تَكُونَ صَائِمًا»

وَأَمَّا) الْغُسْلُ الْمَفْرُوضُ فَثَلَاثَةٌ: الْغُسْلُ مِنْ الْجَنَابَةِ، وَالْحَيْضِ، وَالنِّفَاسِ أَمَّا الْجَنَابَةُ فَلِقَوْلِهِ تَعَالَى {وَإِنْ كُنْتُمْ جُنُبًا فَاطَّهَّرُوا} [المائدة: 6] ، أَيْ: اغْتَسِلُوا
