Fatwa :22481 : Please Review Before sunset the pilgrim should leave Arafat to arrive in Muzdalifah in time for Maghrib .(Maghrib should not be performed along the way). Every book writes : Cannot leave Arafah before sunset. Leave for Muzdalifah after sunset without praying Maghrib And please answer After performing Umra of Tamatttu and before commencement of Hajj ,may we go al- Hill area which is within Miqat but outside Haram boundary for example to visit Arafat,Ta'nim or say Jeddah and come back to Mecca without any obligation of donning Ihram on re-entry to Haram precinct?
Answer :
In the Name of Allah, the Most Gracious, the Most Merciful. As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh. We have reviewed the Fatwaa in reference. Hereunder are our observations: It is not permissible for one to leave Arafah before sunset. One will leave after sunset without performing Maghrib. After performing the Umrah of Tamattu’, it is permissible to visit the al-Hill areas. Upon returning to Mecca from al-Hill, it is not necessary for a Mutamatti’ (one doing Hajj Tamattu’) to don Ihram unless he/she has intention to perform Umrah. (قوله ليتحقق نوع سفر) لأن أداء الحج في عرفة، وهي في الحل فيكون إحرام المكي بالحج من الحرم ليتحقق له نوع سفر بتبدل المكان، وأداء العمرة في الحرم فيكون إحرامه بها من الحل ليتحقق له نوع من السفر شرح النقاية للقاري فلو عكس فأحرم للحج من الحل أو للعمرة من الحرم لزمه دم إلا إذا عاد ملبيا إلى الميقات المشروع له كما في اللباب وغيره (رد المحتار، ج 2، ص 478-479، سعيد)
