I am writing to your response to my question, Fatwa#: 34104.
When someone asks my uncle to leave the haram things in his business, he says that he cannot run his business without those things (which is his own wrong perception as my other uncle is running a completely halal restaurant in that same city). Anyway, according to my honest discretion, the majority of his income is haram, as almost all of his customers are non-muslims and alcohol is served on almost every table and the dishes having meat in them are also not halal.
So guide me that if the majority of his income is haram then what should be the ruling about accepting gifts from him? And guide me about the diplomatic way of dealing with him. And now that he refused to take his money back, what should I do with this money? I have read fatawa that if we have haram money, we should give it in charity with the intension of getting rid of it and not with the intension of getting any reward. Is that fatwa also applies here?
Also, you did not answer the second part of my question regarding accepting gifts from non-Muslims knowing their income is not halal Islamically.

Answer :

In the Name of Allah, the Most Gracious, the Most Merciful.
As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.
If ones parents were not believers, Allah has ordered us to be respectful and so is the case with all relatives.
{وَإِنْ جَاهَدَاكَ عَلَى أَنْ تُشْرِكَ بِي مَا لَيْسَ لَكَ بِهِ عِلْمٌ فَلَا تُطِعْهُمَا وَصَاحِبْهُمَا فِي الدُّنْيَا مَعْرُوفًا} [لقمان: 15]
(While you should always obey your parents, you may not obey them when they command you to do anything that violates the Shariah. Therefore) If they (your parents) force you to ascribe such partners to Me, about which you have no knowledge but (this is no excuse to still) cordially associate with them in this world them to sever relations try to make you ascribe partners with me of those things about which you have no knowledge so don not follow them in that.
In the same breath, you are supposed to honour your uncle. Whilst, he may not be your biological father, Shariah has given him a right that makes him almost equal to your father.  Consider the following hadith:
قال أما علمت أن عم الرجل صنو أبيه
“Don’t you know that a person’s uncle is equivalent to his father?”
Your attitude to abide by the rulings of Shariah and to prevent from wrong is truly commendable. However, you should remember that trying to change someone immediately is a very big challenge. You must realise that this cannot happen overnight, therefore you must be very patient in preventing someone from wrong. Also, in giving dawah, one must be very tactful and not do it in a way that will offend the one being prevented. Allah himself orders us in the Quran that 
{ ادْعُ إِلَى سَبِيلِ رَبِّكَ بِالْحِكْمَةِ وَالْمَوْعِظَةِ الْحَسَنَةِ وَجَادِلْهُمْ بِالَّتِي هِيَ أَحْسَنُ} [النحل: 125]
“Call towards the path of your Lord with wisdom and good speech and debate with them with better conduct.”
Also understand that this is his source of income for many years which he cannot immediately do away with. He may take time to adjust. It would be to best to be humble, loving and win him over before imparting him with advice which he will more readily accept. Allah himself orders Hazrat Musa Alayhi Sallam to be soft spoken when addressing a tyrant like Firawn:
{فَقُولَا لَهُ قَوْلًا لَيِّنًا لَعَلَّهُ يَتَذَكَّرُ أَوْ يَخْشَى} [طه: 44]
And speak to him with soft speech (to soften his heart) so he may accept the advice (given to him) or he may start fearing.”
 
In your situation, you can take the money from him and give him something else as a gift which will technically make this a business transaction more than a gift.

 حدثنا علي بن حفص أنا ورقاء عن أبي الزناد عن الأعرج عن أبي هريرة قال بعث رسول الله - صلى الله عليه وسلم - عمر على الصدقة فقيل منع ابن جميل وخالد بن الوليد والعباس عم النبي -صلي الله عليه وسلم - فقال النبي -صلي الله عليه وسلم -: "ما نقم ابن جميل إلا أنه أن كان فقيرًا فأغناه الله، وأما خالد فإنكم تظلمون خالدًا فقد احتبس أدراعه في سبيل الله، وأما العباس فهي عليّ ومثلها، ثم قال أما علمت أن عم الرجل صنو أبيه"

 (وَإِذَا كَانَ الرَّجُلُ يَصُومُ وَيُصَلِّي وَيَضُرُّ النَّاسَ بِيَدِهِ وَلِسَانِهِ فَذِكْرُهُ بِمَا فِيهِ لَيْسَ بِغِيبَةٍ حَتَّى لَوْ أَخْبَرَ السُّلْطَانَ بِذَلِكَ لِيَزْجُرَهُ لَا إثْمَ عَلَيْهِ) وَقَالُوا إنْ عَلِمَ أَنَّ أَبَاهُ يَقْدِرُ عَلَى مَنْعِهِ أَعْلَمَهُ وَلَوْ بِكِتَابَةٍ وَإِلَّا لَا كَيْ لَا تَقَعَ الْعَدَاوَةُ
