Question Summary: Fatwa on Software Development for Law Firms – A clarification Question Detail:
Respected Mufti Sb Assalamualikum, With all respect to your Knowledge of Fiqh - I would like to calrify on the details about a fatwa asked earlier on Software Development for Law Firms 1) I engaged my self with a client who develops products for Legal Firms in North America / Europe. Will i be responsible if the Software is used by Legal Firms to track cases / documents which may be against Shariah(for example it can be used to track documents of any legal case for Banks,Brewery's,Theaters,Criminal activities etc.) 2) Software for Hospitals - These days all Hospitals even in Islamic Countries have Insurance , is it allowed to develop such software which will have an Insurance module to save details of the Insurance Provider which will be later used for Insurance Billing?
Answer :
In the Name of Allāh, the Most Gracious, the Most Merciful. As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh. We commend you on your sensitivity to conform to the laws of Shar‘iah in acquiring halāl income.
Based on the details mentioned in the query, the income earned from developing a software for a Law Firm is halāl as there is no active participation in harām.[1]
Similarly is the case in developing the software in reference for hospitals. The income is halāl as there is no active participation in harām, provided that the software is meant to merely “save details of the Insurance Provider which will be later used for Insurance Billing”.
