1. Is it permissible to go to the masjid to listen to a lecture. I dont normally go to the masjid, but sometimes my teacher wants me to go if a scholar comes. There is complete seperation between the men and women. Sometimes the lectures are held at an islamic center. Will it be permissible to attend it there ? 2. Can a male teacher teach female students(with niqab)without a curtain?
Answer :
In the Name of Allah, the Most Gracious, the Most Merciful. As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh. Sister in Islam, 1. Shariah encourages a women to perform her Salah at home. Consider the following Hadith: صَلَاةُ الْمَرْأَةِ فِي بَيْتِهَا أَفْضَلُ مِنْ صَلَاتِهَا فِي حُجْرَتِهَا، وَصَلَاتُهَا فِي مَخْدَعِهَا أَفْضَلُ مِنْ صَلَاتِهَا فِي بَيْتِهَا Translation: It is more virtuous for a woman to perform her Salah in the confines of her house rather than performing it in the courtyard, and it is more virtuous to perform her Salah in an inner room than performing it in other sections of the house. [1] Your practice of not attending the Masjid is praiseworthy. When Shariah has encouraged women to perform Salah at home, the attitude of Shariah for women to listen to talks etc. at the Masjid which is of a lesser degree than Salah can be understood from the analogy of Salah. However, this does not mean women cannot benefit from the discourses held at the Masjid. In this era of technological advancement, one can listen to the program without personally being present in the Masjid. The ideal and preferred method to adapt would be to listen to the program at home via Masjid receiver (if available) or listen to a recording. 2. A Ghair Mahram should not teach female students without a curtain even though the students are wearing the niqaab. Moreover, it is not permissible for a Ghair Mahram to speak to a woman nor is it permissible for men to listen to the voice of a women. A woman may speak to a Ghair Mahram in her normal voice only in case of necessity. [2] You may take your classes from a female teacher. It is your responsibility to request the institute to provide a female teacher for your classes. [2] (وَلِلْحُرَّةِ) وَلَوْ خُنْثَى (جَمِيعُ بَدَنِهَا) حَتَّى شَعْرُهَا النَّازِلُ فِي الْأَصَحِّ (خَلَا الْوَجْهِ وَالْكَفَّيْنِ) فَظَهْرُ الْكَفِّ عَوْرَةٌ عَلَى الْمَذْهَبِ (وَالْقَدَمَيْنِ) عَلَى الْمُعْتَمَدِ، وَصَوْتُهَا عَلَى الرَّاجِحِ وَذِرَاعَيْهَا عَلَى الْمَرْجُوحِ
(قَوْلُهُ وَصَوْتِهَا) مَعْطُوفٌ عَلَى الْمُسْتَثْنَى يَعْنِي أَنَّهُ لَيْسَ بِعَوْرَةٍ ح (قَوْلُهُ عَلَى الرَّاجِحِ) عِبَارَةُ الْبَحْرِ عَنْ الْحِلْيَةِ أَنَّهُ الْأَشْبَهُ. وَفِي النَّهْرِ وَهُوَ الَّذِي يَنْبَغِي اعْتِمَادُهُ. وَمُقَابِلُهُ مَا فِي النَّوَازِلِ: نَغْمَةُ الْمَرْأَةِ عَوْرَةٌ، وَتَعَلُّمُهَا الْقُرْآنَ مِنْ الْمَرْأَةِ أَحَبُّ. قَالَ - عَلَيْهِ الصَّلَاةُ وَالسَّلَامُ - «التَّسْبِيحُ لِلرِّجَالِ، وَالتَّصْفِيقُ لِلنِّسَاءِ» فَلَا يَحْسُنُ أَنْ يَسْمَعَهَا الرَّجُلُ. اهـ. وَفِي الْكَافِي: وَلَا تُلَبِّي جَهْرًا لِأَنَّ صَوْتَهَا عَوْرَةٌ، وَمَشَى عَلَيْهِ فِي الْمُحِيطِ فِي بَابِ الْأَذَانِ بَحْرٌ. قَالَ فِي الْفَتْحِ: وَعَلَى هَذَا لَوْ قِيلَ إذَا جَهَرَتْ بِالْقِرَاءَةِ فِي الصَّلَاةِ فَسَدَتْ كَانَ مُتَّجَهًا، وَلِهَذَا مَنَعَهَا - عَلَيْهِ الصَّلَاةُ وَالسَّلَامُ - مِنْ التَّسْبِيحِ بِالصَّوْتِ لِإِعْلَامِ الْإِمَامِ بِسَهْوِهِ إلَى التَّصْفِيقِ اهـ وَأَقَرَّهُ الْبُرْهَانُ الْحَلَبِيُّ فِي شَرْحِ الْمُنْيَةِ الْكَبِيرِ، وَكَذَا فِي الْإِمْدَادِ؛ ثُمَّ نَقَلَ عَنْ خَطِّ الْعَلَّامَةِ الْمَقْدِسِيَّ: ذَكَرَ الْإِمَامُ أَبُو الْعَبَّاسِ الْقُرْطُبِيُّ فِي كِتَابِهِ فِي السَّمَاعِ: وَلَا يَظُنُّ مَنْ لَا فِطْنَةَ عِنْدَهُ أَنَّا إذَا قُلْنَا صَوْتُ الْمَرْأَةِ عَوْرَةٌ أَنَّا نُرِيدُ بِذَلِكَ كَلَامَهَا، لِأَنَّ ذَلِكَ لَيْسَ بِصَحِيحٍ، فَإِذًا نُجِيزُ الْكَلَامَ مَعَ النِّسَاءِ لِلْأَجَانِبِ وَمُحَاوَرَتِهِنَّ عِنْدَ الْحَاجَةِ إلَى ذَلِكَ، وَلَا نُجِيزُ لَهُنَّ رَفْعَ أَصْوَاتِهِنَّ وَلَا تَمْطِيطَهَا وَلَا تَلْيِينَهَا وَتَقْطِيعَهَا لِمَا فِي ذَلِكَ مِنْ اسْتِمَالَةِ الرِّجَالِ إلَيْهِنَّ وَتَحْرِيكِ الشَّهَوَاتِ مِنْهُمْ، وَمِنْ هَذَا لَمْ يَجُزْ أَنْ تُؤَذِّنَ الْمَرْأَةُ. اهـ. قُلْت: وَيُشِيرُ إلَى هَذَا تَعْبِيرُ النَّوَازِلِ بِالنَّغْمَةِ
