Sexual Intercourse in Menses

Question Detail:

I have done sex with my wife during menses, so now i want to know that what is my punish in islam, kindly reply as soon as possible.

Answer :

In the Name of Allah, the Most Gracious, the Most Merciful.
As-salamu’alaykum wa-rahmatullahi wa –barakatuh.
It is prohibited for a husband to have intercourse with his wife during menses. Allah Ta’ala says in the Quran: 
وَيَسْئَلُونَكَ عَنِ الْمَحِيضِ قُلْ هُوَ أَذىً فَاعْتَزِلُوا النِّساءَ فِي الْمَحِيضِ وَلا تَقْرَبُوهُنَّ حَتَّي يَطْهُرْنَ
 “They ask you (O Muhammad ٍSallallahu Alaihi Wasallam) concerning menstruation. Say, “It is impure so leave (intercourse with) women during (their period of) menstruation and do not go unto them (do not have sexual relations with your wives) until they are cleansed (until the menstrual cycle is complete)” (Surah Baqara 2; 222)
To have intercourse during menses is a major sin.[1]It is mentioned in a Hadeeth:
 
…..He who has intercourse with his wife in her menses…..has refuted that which was revealed to Muhammad Sallallahu Alaihi Wasallam.” (Becomes a non- believer) (This applies to one who regards it to be permissible while knowing it is Haraam)[2]
Once Abu Bakr Radiallahu Anhu was asked about a person who has intercourse with his wife in her menses and he replied, “Ask of repentance from Allah and do not exceed the limits.”[3]
You should regret your act and sincerely repent to Allah for such a heinous act. It is advisable for you to give some Sadaqah to compensate for your sins in invoking the forgiveness of Allah.

[1]1}{فَاعْتَزِلُوا النِّسَاءَ فِي الْمَحِيضِ} [البقرة: 222] الْآيَةُ فَذَلِكَ تَنْصِيصٌ عَلَى حُرْمَةِ الْغَشَيَانِ فِي أَوَّلِ الْحَيْضِ وَآخِرِهِ{َ المبسوط للسرخسي، ج 3، ص 152}

 

2} ولا تقربوهنَّ حتى يطهرن} (البقرة: 222) ، دليل على أن الحرمة تمتد إلى الطهر{ المحيط البرهاني، ج 5، ص 338}

3} مَنْ أَتَى امْرَأَتَهُ فِي دُبُرِهَا أَوْ حَائِضًا أَوْ صَدَّقَ كَاهِنًا فَقَدْ كَفَرَ بِمَا أُنْزِلَ عَلَى مُحَمَّدٍ { معرفة السنن والآثار، ج 10، ص 163}2

 

34}(وَيَحْرُمُ وَطْؤُهَا) لِقَوْلِهِ تَعَالَى: {وَلا تَقْرَبُوهُنَّ حَتَّى يَطْهُرْنَ} [البقرة: 222] وَالنَّهْيُ لِلتَّحْرِيمِ، وَإِنْ وَطِئَهَا فِي الْحَيْضِ إِنْ كَانَا طَائِعَيْنِ أَثِمَا، وَيَكْفِيهِمَا الِاسْتِغْفَارُ وَالتَّوْبَةُ، لِقَوْلِ الصِّدِّيقِ - رَضِيَ اللَّهُ عَنْهُ - لِمَنْ سَأَلَهُ عَنْ ذَلِكَ: اسْتَغْفِرِ اللَّهَ وَلَا تَعُدْ. وَإِنْ كَانَ أَحَدُهُمَا طَائِعًا وَالْآخَرُ مُكْرَهًا أَثِمَ الطَّائِعُ وَحْدَهُ. قَالَ فِي الْفَتَاوَى: وَهَذَا فِي الْحُكْمِ، وَيُسْتَحَبُّ أَنْ يُتَصَدَّقَ بِدِينَارٍ أَوْ نِصْفِ دِينَارٍ. قِيلَ: مَعْنَاهُ إِنْ كَانَ فِي أَوَّلِ الْحَيْضِ فَدِينَارٌ، وَفِي آخِرِهِ نِصْفُهُ. وَقِيلَ: إِنْ كَانَ الدَّمُ أَسْوَدَ فَدِينَارٌ، وَإِنْ كَانَ أَصْفَرَ فَنِصْفُهُ، وَبِجَمِيعِ ذَلِكَ وَرَدَ الْحَدِيثُ.

(وَيَكْفُرُ مُسْتَحِلُّهُ) لِأَنَّ حُرْمَتَهُ ثَبَتَتْ بِالْكِتَابِ وَالْإِجْمَاعِ
