Can I go for Hajj taking a loan from the bank? Can I give Zakat to my sister?

My mother wishes to go for haj & i want to accompany her with my wife, i asked one of the scholars about haj, he said haj is fard if you have an amount to cover the haj trip + the amount to cover your household expenses during the haj period.
My question is : i do not have cash with me to cover the haj trip, but my mother & my wife have jewelleries more than the value of nisaab & i have a plot which is for long term investment.
1) I dont want to sell my plot & jewelleries of my mother & wife. Instead i have planned to take a personal finance for 5 years from islamic bank for haj & to cover the expenses of all three members &  for constructing a home for myself. I will get permission from the bank to go for haj as it is necessary to obtain permission from my creditors. My company provides me a islamic life insurance ( takaful) in case i die the insurance amount can cover my dues to the bank. My mother & me are very eager to do haj & considering my income & savings it will take years for  me to save money in case i cannot utilise the aforesaid option. Please guide me what i have to do in this situation, is haj fard even if you dont have cash with you? do i need to sell off my property & go for haj or can i take a loan?
2) My sister is widow the only source of income for her is the rental income from her house. The rental income is not high, Currently we are supporting her, she has a jewellery to the nisaab value, does she need to give zakat on her jewellery from her income generated? Can we give zakath to her as she& her son is dependent on us.
 

Answer :

In the Name of Allah, the Most Gracious, the Most Merciful.
As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh. 
If the jewellery in the possession of your mother and wife is sufficient to finance the Hajj then Hajj will be obligatory on them. It is not necessary for them to sell their jewellery to go for Hajj. Likewise, you do not have to sell your land to go for Hajj. You can take a loan to finance your Hajj and arrange to pay the loan later.[1]
 As for the second question, it is not necessary for your sister to pay Zakāh from the income she earns. She can pay Zakāt from the jewellery itself or from another source of wealth. If your sister possesses any form of wealth equivalent to the Nisāb of Zakāh and this wealth is above her basic needs then it will not be permissible to give her Zakāt.[2]

رد المحتار  457/2وَالظَّاهِرُ أَنَّ هَذَا هُوَ الْمُرَادُ أُخِذَ مِمَّا ذَكَرَهُ فِي الظَّهِيرِيَّةِ أَيْضًا فِي الزَّكَاةِ حَيْثُ قَالَ إنْ لَمْ يَكُنْ عِنْدَهُ مَالٌ وَأَرَادَ أَنْ يَسْتَقْرِضَ لِأَدَاءِ الزَّكَاةِ فَإِنْ كَانَ فِي أَكْبَرِ رَأْيِهِ أَنَّهُ إذَا اجْتَهَدَ بِقَضَاءِ دَيْنِهِ قَدَرَ كَانَ الْأَفْضَلُ أَنْ يَسْتَقْرِضَ فَإِنْ اسْتَقْرَضَ وَأَدَّى وَلَمْ يَقْدِرْ عَلَى قَضَائِهِ حَتَّى مَاتَ يُرْجَى أَنْ يَقْضِيَ اللَّهُ تَبَارَكَ وَتَعَالَى دَيْنَهُ فِي الْآخِرَةِ وَإِنْ كَانَ أَكْبَرُ رَأْيِهِ أَنَّهُ لَوْ اسْتَقْرَضَ لَا يَقْدِرُ عَلَى قَضَائِهِ كَانَ الْأَفْضَلُ لَهُ عَدَمَهُ اهـ وَإِذَا كَانَ هَذَا فِي الزَّكَاةِ الْمُتَعَلِّقِ بِهَا حَقُّ الْفُقَرَاءِ فَفِي الْحَجِّ أَوْلَى.

فتاوي قاضيخان 126/1وإن لم يكن عنده مال وأراد أن يستقرض لأداء الزكاة فإن كان في أكبر رأيه أنه إذا استقرض وأدى الزكاة واجتهد لقضاء دينه يقدر على ذلك كان الأفضل له أن يستقرض فإن استقرض وأدى ولم يقدر على قضاء الدين حتى مات يرجى أن يقضي الله تعالى دينه في الآخرة وإن كان أكبر رأيه أنه إذا استقرض لا يقدر على قضاء الدين كان الأفضل له أن لا يستقرض لأن خصومة صاحب الدين أشد
