I want to know, if a man was a good practicing Muslim, but he gave his Muslim wife divorce three times, and then gave up the fold of Islam, then after some time he became Muslim by reading Kalimah Shahadah, can he make Nikah to the same wife that he divorced before he left Islam?
Answer :
In the Name of Allah, the Most Gracious, the Most Merciful. As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh. In principle, issuing three divorces constitutes a Talāq al-Mughalladhah (a permanently irrevocable divorce). The consequence of such a divorce is that the issuer of divorce may not remarry his wife until she is married to another man, the marriage is consummated, and she completes her Iddah from the second marriage. (قَوْلُهُ: وَلَا مِلْكُ أَمَةٍ إلَخْ) عَطْفٌ عَلَى قَوْلِهِ " وَطْءُ الْمَوْلَى ": أَيْ لَوْ طَلَّقَهَا ثِنْتَيْنِ وَهِيَ أَمَةٌ ثُمَّ مَلَكَهَا، أَوْ ثَلَاثًا وَهِيَ حُرَّةٌ فَارْتَدَّتْ وَلَحِقَتْ بِدَارِ الْحَرْبِ ثُمَّ سُبِيَتْ وَمَلَكَهَا لَا يَحِلُّ لَهُ وَطْؤُهَا بِمِلْكِ الْيَمِينِ حَتَّى يُزَوِّجَهَا فَيَدْخُلَ بِهَا الزَّوْجُ ثُمَّ يُطَلِّقَهَا كَمَا فِي الْفَتْحِ.
