Wife asked for a talaaq. Husband said ''ok take your talaaq I've tried hard''. Does it count or does he still have to give it and say I talaaq u.
Answer :
In the Name of Allah, the Most Gracious, the Most Merciful. As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh. In principle, issuing a Talaq is not restricted to the words “I divorce you.” In the enquired situation one revocable Talaq (rajiy) has taken place.[i] The iddah of the wife has commenced from the time the words were uttered. However the husband can verbally retract the wife back into the Nikah if her iddah period has not expired which is three menstrual periods. After the iddah, the Nikah is broken and they can only get back together after a new Nikah has been performed.[ii] And Allah Ta’āla Knows Best Imran Patel Student Darul Iftaa Zambia Checked and Approved by, Mufti Ebrahim Desai.
