Assalamalaikum - asked this question 2 weeks ago, but no response to date. Would be extremely grateful if you could look into it. JZK ---------------------------------------- Are the following scenarios deemed "valid seclusion" - "Khalwa Sahiha" Dear respected scholar, Kindly consider the following 3 scenarios:
 
Scenario 1: After nikah, groom visits bride and the bride's sister at an apartment. The sister is a sane adult. Bride, Groom and Sister all meet in the reception room. After a while, the sister goes into a nearby room for 5 minutes to make a phone call. The reception room door is left open and the sister can freely enter/exit and can see/hear into the reception room where the bride and groom are. After the phone call, the sister returns to the room where the bride and groom are. The bride and groom do not have physical relations nor consummate -----------------------
 
Scenario 2: After a Nikah, a Bride and groom are in the reception room of a house. The reception room door is closed but not locked and one female adult relative is freely entering and exiting from an adjacent room as she wants to spend time with the newly wed couple. The longest time the relative is out of the room at any one stretch is 10 mins. The bride and groom have no prior knowledge/warning of when the relative enters/exits.The bride and groom do not have physical relations nor consummate ------------------------
 
Scenario 3: As per scenario 2 but additionally the groom has a contagious sexually transmitted disease that can pass on to the bride. The disease is genital warts (HPV virus) which can cause cervical cancer in women. Contraception is not an effective barrier for this disease as any skin contact of any part of the wider groin area can transmit the virus. Both the bride and groom have been warned by the Physician who made the diagnosis to strictly refrain from any skin to skin contact or physical activity until the bride is vaccinated. As the vaccination shots have not yet been administered, the couple are unable to consummate nor have kind of physical contact as per the physicians advice. ----------------------
 
QUESTION: In each of the above three scenarios, has a valid proper seclusion (Khalwa Sahiha) between the bride and groom taken place? jazakhalla khair

Answer :

 
In the Name of Allah, the Most Gracious, the Most Merciful.
As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.
No, this is not a valid seclusion [khalwah sahihah] as the door was open and anyone may enter upon the couple. 
 
If that female relative was entering upon the couple without seeking permission to do so (as is understood from the inquiry) then, no, this is not a valid seclusion since the couple were not assured privacy. 
 
No, this is also not a valid seclusion for the reason cited in #2 and the virus in the husband. [i] [ii] [iii] [iv]

إذا خلا بامرأته في البيت القصوى إن كانت الأبواب مفتوحة من أراد أن يدخل عليهما يدخل من غير استئذان [i]
 لا تصح الخلوة وكذا لو خلا بها في بيت من دار وللبيت باب مفتوح في الدار إذا أراد أن يدخل عليهما غيرهما من المحارم أو الأجانب يدخل لا تصح الخلوة
  فتاوى قاضيخان، ١/ ١٩٦ 
قوله وبيت بابه مفتوح) أي بحيث لو نظر إنسان رآهما، وفيه خلاف.) [ii]
ففي مجموع النوازل: إن كان لا يدخل عليهما أحد إلا بإذن فهي خلوة. واختار في الذخيرة أنه مانع وهو الظاهر بحر. ووجهه أن إمكان النظر مانع بلا توقف على الدخول، فلا فائدة في الإذن وعدمه

والمكان الذي تصح فيه الخلوة أن يكونا آمنين من اطلاع الغير عليهما بغير إذنهما كالدار والبيت كذا في شرح  [iii]
 الجامع الصغير لقاضي خان ولا تصح الخلوة في الصحراء ليس بقربهما أحد إذا لم يأمنا مرور إنسان وكذا لو خلا على سطح ليس على جوانبه ستر أو كان الستر رقيقا أو قصيرا بحيث لو قام إنسان يقع بصره عليهما لا تصح الخلوة إذا خافا هجوم الغير فإن أمنا صحت الخلوة، كذا في الظهيرية
الفتاوى الهندية، ١/ ٣٠٥ 
قوله كمرض لأحدهما يمنع الوطء) أي أو يلحقه به ضرر. قال الزيلعي: وقيل هذا التفصيل في مرضها، وأما مرضه) [iv]
 فمانع مطلقا لأنه لا يعرى عن تكسر وفتور عادة وهو الصحيح اهـ ومثله في الفتح والبحر والنهر
قلت: إن كان التكسر والفتور منه مانعا من الوطء أو مضرا له كان مثل المرأة في اشتراط المنع أو الضرر وإلا فهو كالصحيح
