Question Summary: If a divorce was to happen islamicaly does my wife take half of everything I own? Question Detail:
My question is regarding Inheritance. If a divorce was to happen islamicaly does my wife take half of everything i own for example my house is under my name does she own half? What is the ruling for this particular scenario?
Answer :
In the Name of Allah, the Most Gracious, the Most Merciful. As-salāmu ‘alaykumwa-rahmatullāhiwa-barakātuh. Inheritance is upon the death of a person and not upon divorce. According to the Shariah, marriage is separated from proprietary rights. If a divorce takes place, the divorced spouses are not entitled to the possession of the other by virtue of marriage. It is incorrect for a divorced person to claim the possession of his/her spouse. That will be regarded as usurpation which is clearly prohibited and a major sin. Allah says. يَاأَيُّهَا الَّذِينَ آمَنُوا لَا تَأْكُلُوا أَمْوَالَكُمْ بَيْنَكُمْ بِالْبَاطِل(سورة النساء) Translation: O you who believe, do not devour each other‘s property by false means (Surah: Nisaa verse, 29) And Allah Ta’āla Knows Best Zakir Husain Student DarulIftaa Michigan, U.S.A Checked and Approved by, Mufti Ebrahim Desai. __________________________________________________ وإذا طلق الرجل امرأته فلها النفقة والسكنى في عدتها، رجعيا كان أو بائنا(بناية شرح الهداية،دار الكتب العلمية،٥/٦٨٩)
